Innocent

My name is Breezetta (Breeze) Etienne. I am a Black woman serving my country as a physician-assistant in the Air Force at Grand Forks Air Force Base, ND. I am writing on behalf of Moe GIbbs, my brother, a Black man who has been in Cass County jail in Fargo, ND for over a year for a murder he did not commit.

I am desperately trying to get his story out to the
public. He has had several other bogus charges raised
against him since his arrest for murder. No doubt they
have been trumped up in an effort to hang him one way
or another. The prosecution knows they have no case
against him, so they have made him look like a monster
to the public and the jury pool has been extremely
tainted. He has had one trial already in Minot, ND
that ended in mistrial with a hung jury. Therefore,
all the information pertaining to his case has been
publicized (his trial was televised) and I want to
share that information with everyone who will listen.

Prior to the first trial, Moe Gibbs and those who knew
he was wrongly accused had very little concern for how
the trial would end. The facts are very clear in this
case. He has a few family members locally, and maybe
three who were able to come for a few days of the
trial from out of state. His immediate family were
all subpoenaed for the trial, and therefore could not
be in the court room to support him. All in all, he
had on average five supporters present, 3 of which
were Black. Little did we know that Moe was up
against an entire community, and now apparently the
state of ND desperate to make someone pay for the
death of a beautiful young co-ed girl, Mindy
Morgenstern.

Internet blogs and radio commentary have been blatant
in their prejudice. The majority opinion of North
Dakota has been stated in the news, newspapers, radio,
and all over the internet. "Outsiders" are bringing
down the state of North Dakota. The 'N' word has
never been used so much as what I have heard of late.
During the first trial, the defense team and Moe's
family were forced to get restraining orders because
of death threats. Our cars were vandalized. We were
forced to take refuge on the Air Force Base due to
members of the victim's boyfriend's family following
us. My confidence in the judicial system and trust in
the reports of the media has plummeted. The media has
made it very clear where their support is.. printing
negative and altered statements that paint Moe as a
monster, rapist, and murderer. Numerous letters have
been written to the media in attempts to bring the
truth out. Not one of our comments or letters have
been reported. We have asked for help in vain. Moe
now is about to stand trial again; jury selection
begins 22 October. This time the defense isn't so
confident; North Dakota jury has shown they are
willing to turn their head to the truth. Please take
10 minutes to read our story.

In theory, prison is a place of rehabilitation. The
rate of recidivism is a stark reminder at the failure
of this institute. However, there is the rare
exceptional convict that learns from their misjudgment
and previous failure in character. Occasionally a
person will learn after being imprisoned for a crime
that they do not belong in and never want to return to
prison. Some ex-convicts are able to regain control
of their life. Unfortuntately, once a convicted
felon, you are permanently labeled. Regardless of
your attempts to prove yourself worthy of trust, if a
crime is committed in an ex-cons vicinity, you better
believe you will be one of the "usual suspects'.

Moe Gibbs is a prime example of a rehabilitated
ex-convict who served his time in prison and chose to
never return to such a place. As a late teen, Moe (at
the time Glen Morgan was his legal name), was
convicted of unpremeditated attempted murder while in
the Navy. Growing up without a place to call home nor
a nurturing hand of guidance, Moe found family and
acceptance in a street gang. He took part in what was
supposed to be a drive-by, but since he was not the
shooter, he plead innocent to the charge of attempted
murder. He spent 6 years in federal prison in
Leavenworth , KS .

He did away with all gang ties. Per his military
prison record, he was a model prisoner. He stayed out
of trouble and promised he would never go back to
prison again. He was a fortunate one. Even prior to
his arrest, he never got mixed up in drugs, alcohol,
robbery, or rape. He never had to act tough to gain
respect. To this very day, I have never heard him
utter a curse word. Never. He has always had
self-discipline and was never known to be moved to
action by peer pressure alone. I remember once when I
was 13, he saw me about to try to smoke marijuana. He
looked over at me and said gently, "give that back,
you don't need that"?. He said it quietly and without
embarrassing me. Later I asked him about it and he
said drugs are just stupid, you don't need them. He
said he had never touched any of that stuff and for me
not to either.

Moe worked very hard after he was released from
prison. He wasn't on parole or probation. He had to
work two and three hard labor menial jobs because no
one wanted to hire an ex-con. Even if he didn't
reveal he had been in prison, he still hadn't had a
job in over 6 years. He rented out rooms because he
couldn't afford an apartment. He stayed clear, very
clear, of anything that was going to attract trouble
or get him in trouble with the law. He tried his hand
at boxing for a few years. He was able to make easier
money that way, but he never had the head for boxing.
He was strong, but as mom put it, "he could never be a
great boxer because he can't get angry enough!"

For almost 10 years, he worked to recover from his
past and build his future. He went to school and
played college sports; at 30 years old, he was finally
living out his childhood. He felt good about himself.
He sent me copies of his grades and invited me to his
college games. He started his own painting business.
In 2005, Moe's Dad refused to answer his phone calls
and brushed Moe off over a pair of shoes he did not
want to return to Moe. Moe was so fed up, he said he
was going to disown his father because he never was a
dad to him anyway. While in the Navy, people are
called by their last names. He picked up the nickname
"Moe"?, which was short for Morgan. At the time he
decided to change his name, he was in love and going
to marry (he was always in love and marrying someone),
with an NDSU girls' basketball team player with the
last name Gibbs. So he legally changed his name to
Moe Maurice Gibbs.

In 2006, he thought he was finally close to having a
normal life. He married his pregnant fiance. He
moved to Valley City , ND where his in-laws lived. He
joined the volunteer fire dept. He coached boys
basketball. And he worked as a jailor at the Barnes
County Police Dept. He was so proud. He once told me
that he was offered to get weapons training for a
position and was so tempted to take it. He declined
however, saying it would be nice but he knew as an
ex-felon he was not to ever have a gun in his
possession. Life wasn't perfect. He always had and,
despite being married, still had trouble being with
only one woman. However, for the first time, ever
really, life was good for Moe.

On September 22, 2006 my mother called me frantic and
crying and told me to turn on the news. Moe had been
arrested for the murder of Mindy Morgenstern, a 22
year old college student of Valley City State
University .

Yes, it was quite devastating for our family to hear
Moe was arrested. We are not so naive to think that
he is perfect, nor that it isn't impossible for
someone to "snap" and do something out of what we
know his character to be. However, the FACTS of this
investigation show very clearly an injustice is taking
place. There was a rush to judgment and arrest due to
extreme pressure the small town of Valley City , ND
placed on the Barnes County police and sheriff's
department. A Black man has been falsely accused,
arrested and jailed for over a year now. It has been
said openly all over the newspapers, news, radio, and
public that he will never get a fair trial in North
Dakota . The location of trial has been moved four
times already. The most recent move was due to a
radio station taking 3 hours every day to take calls
and make comments apparently to taint the jury pool.
For example, one comment made on the air was "they
ought to hang that nigger in the parking lot". Well
he has been moved to the last city in North Dakota ,
there is no other place he can have this trial. The
trial is now to be held in the capital city, Bismarck
, ND -- not surprisingly was recently rated the #10
whitest city in the nation. It is also only 30 minutes
from the hometown of Mindy Morgenstern and home of the
ND Bureau of Criminal Investigations offices -- where
the entire prosecution team is located.

I will give some background to the case. If there is
ANYTHING that you or your organization would need in
terms of investigation reports, statements from
witnesses, video interviews, crime scene pictures, etc
that would help our case and prove to you all there
has been a huge injustice has taken place, I can
supply that. It is obscene what is happening here in
North Dakota and I could not believe it could still
happen in the United States in 2007.

On September 13th, 2006, Mindy Morgenstern a 22 year
old college student, was found murdered in her
apartment. She was found in the entry hallway, lying
on her back with one kitchen knife still in her
throat, and another knife leaning against her
shoulder. Both knife handles were broken from the
force. There was also a cloth belt still tightened
around her throat that had also torn and frayed at the
end from the force. She was fully clothed, later
found to have no signs of a sexual assault. She had
her purse still hanging on her shoulder and her keys
close to her on the floor. There was a 5 inch long
grayish-blonde single strand of hair in her left hand.
Later was found 4 other hairs on her body and 1 in
the pool of blood at her head. There was an empty
pine-sol bottle leaning against her trunk and she had
chemical burns from pine-sol all over her face, chest,
and abdomen. On her kitchen table, there were about 6
photographs spread out evenly next to eachother.
Pictures of her and two girlfriends at a cabin, lying
out in bathing suits. There was nothing apparently
stolen or missing from her apartment.

Moe gave a statement to police as the other apartment
residents did. He said he was in and out that day,
making about three trips to his in-laws home. He, as
he always did, was watching his step-daughter during
the day while Chrissy worked. He worked nights at the
Barnes County Jail as a jailor. During the time frame
that Mindy was thought to be killed, he said he
thought that was one of the times he was at home in
the apartment. Since he placed himself at the scene,
he was asked to come back and give another statement.
At that time, they took DNA samples from him, this was
about 10 days after the murder.

Within 24 hours, he was asked to return a third time,
for which he did voluntarily. At the end of this
visit, he was told that his DNA matched DNA found
under Mindy's fingernails and also with a DNA sample
that was taken in a rape case from 2004. He was given
and passed a lie detector test when asked about his
involvement in the murder. He has been in jail since
this visit.

On his lie detector test, he was found dishonest on
one item, about his past. Once confronted about that,
he told them about his time spent in prison when he
was 19. He spent 6 years in military prison for
"attempted pre-meditated murder". He was involved
with the Crips gang as a teenager and at 18 was given
the option by a judge to go to prison or join the
military. A year later, he was involved in what was
labeled a drive-by. A young lady bystander was shot
in the thigh. She suffered a superficial wound and
actually testified to Moe's defense that he was in the
back seat and was not the shooter. Moe plead
not-guilty, but was found guilty by a military trial
by jury and sentenced to 10 years.

During that time, he told me he would never go to jail
again, he was done with that. He served his time, was
offered 10 years of probation in term for early
release, but declined. He said when he was done, he
wanted be totally done. He kept his word. In the 10
years since his release, his only brush with the law
had been 1 speeding ticket. He had this dream of
having a family, something we did not have growing up.
He went through many, many relationships with
females. This would be his weakness and his downfall.

We grew up with conditional love. Our mother was
married and divorced from both of our fathers soon
after having us. She never believed the woman had to
keep the children, and we went from relative to
relative, god-mother, friends of the family, whoever
was willing to take us. If we did live with her, as
soon as we got into any trouble, we had to leave. We
grew up longing to be with our mother we loved, and to
have a 'normal' family. We grew up wondering why our
mother did not want us. Moe got into trouble a lot
and spent most of his years from 8 to 18 in boys homes
or detention homes. He was involved in the Crips
gang, but at that time, that meant fighting. There
wasn't any guns or knives involved. He never stole.
He never had any criminal activity against women. He
NEVER EVER even tried drugs and had no dealings with
drugs. He never smoked. He didn't try alcohol until
he was in the Navy, and never picked up that habit
either. He never and still to this day, never uses
curse words. He is my brother, and I have NEVER EVER
heard him yell or lose his temper. In comparison to
me, he was a total square. He has self-control like
no one else I know in the world.

There is one area that Moe has very little
self-control. Moe loves women. Only while sitting in
jail over the last year has he been able to find out
what his issue was. He says he has a sex addiction.
But it isn't the sex act he is addicted to, but that
feeling of being in a relationship and being loved.
Ask ANY ONE, Moe will meet a girl, on the second date
he is talking about marriage and asking them to have
his child. No exaggeration. Sometimes the first
date. Every female he is with, he says "No, this is
for real, my true love". He wasn't a womanizer in the
fact that he never hit, nor yelled at, or demeaned his
girlfriends. However, he had this picture of a
perfect relationship and as soon as something happened
to smudge that picture, he was gone. He is very
non-confrontational. He will not stand and argue with
someone, he just shrugs his shoulders and will move
on. He always had another women on the backburner. He
has always been charismatic and handsome and he has
many 'girlfriends'. He admits to having brought women
home from the nightclub and sleeping with them, (which
is undoubtedly how he got himself into this entire
situation in the first place). But when he is with
them, they are the only person that matters to him.
After he was arrested, there was an article in the
newspaper where a journalist interviewed 3 of his
x-girlfriends from 3 different states. They all said
the same thing in essence, they couldn't stand him
because he was a dog- but he never hit them, yelled at
them, or mistreated them. They all had a child for
him. None of them said he was capable of doing such a
murder. I will attach that article to another email.

So when I first heard he was arrested, the only thing
I could imagine was maybe he was having an affair with
Mindy and something went terribly wrong. We could
only guess because we did not get to talk to him for
three long days. When I finally spoke to him, I first
asked if he was seeing Mindy. I knew of two other
females he spoke to besides his wife, but have never
heard of her. He said no. They had never spoke on the
phone, emailed, and they had absolutely no
relationship besides once in a while passing in the
apartments and saying hi.

So, my next question of course, how in the world did
your DNA get under her nail?? He shook his head and
said he had no idea, he didn't understand it, but he
didn't kill her. He said the most contact they ever
had was one day, he thought maybe a day or two prior
to her killing, he saw her walking into the apartment
building. He said he was in the middle of loading
some boxes into the car, and he had his step-daughter
as usual. He said she was coming in the door carrying
two laundry baskets, her back pack was on her
shoulder, and he said she was trying to push up her
waistband of her belt with her elbow because her pants
were loose and falling down. He asked her if he could
help her and he carried her two laundry baskets up the
stairs for her. She had held his step-daughter's
hand to help her walk up the stairs. He said he walked
into the entryway, about two steps into her apartment.
He said she took the baskets from his hands, she set
them on the floor. He looked around once and said
"Nice apartment, it looks a lot like mine". and then
he left. That was their only 'close' encounter.

Mindy lived on the 2nd floor of the apartment building
alone. Moe lived on the first floor with his now
x-wife, Chrissy, who was pregnant at the time and his
14-month old step-daughter. They had put in a 60-day
notice that they were vacating their apartment and had
been slowly moving to his Chrissy's parents' home.
They planned to move to her parents basement to save
up money to eventually purchase a home. Since Chrissy
was about 7 months pregnant, Moe did the moving on his
own. He would move a few boxes here and there anytime
they would make a trip to the in-laws home. This had
already been going on for about 2 weeks. On the day
he helped her up the stairs, he was sweaty, had not
showered yet that morning from when he got off work
and took a nap, and he has all year long allergies.
His nose constantly runs and drips and has since he
was just a toddler.

Mindy was adopted by a white family in New Salem, ND.
She was actually medium to dark skinned, and appeared
to be mixed with black and white. New Salem has no
other blacks, Valley City has a handful of black
college students, and only a couple of black family's
considered permanent residents. At the time, she had
a 'boyfriend' (Jordan Ranum) that she was intimate
with and spoke with daily, but for whatever reason,
told all of her friends that they were "only friends".
She had gotten out of a serious relationship a year
and a half earlier with Kyle Kuznia. They dated
seriously for 2.5 years and had talked about marriage.
Kyle's mother admittedly "could not stand" Mindy and
did not approve of her son dating "all these darkies"
(stated in a taped interview of Kyle's Dad). Mindy
became close with Kyle's father, Rodney, and brother
Kirk, during that time. Mindy had an affair with a
married college coach and that ended her and Kyle's
relationship. Mindy was very distraught and for
months would call Kyle, saying she still loved him and
wanted to be with him. At the time of her death, she
still told her friends she loved Kyle. Ranum was
aware of this- he stated on the witness stand.

After Kyle and Mindy broke up, she developed a, as
she herself described it, "strange relationship" with
his father, Rodney. They spoke on the phone daily,
Rodney said in his interview sometimes 15-20 times per
day. That is, until his wife found out. Kyle also
found out and told Rodney that he needed to choose
between Mindy or him. At the time of her death, Kyle
and his father had not really spoken or seen eachother
for months. Rodney would leave Mindy notes that said
"Love Rod" and frequently asked Mindy to meet him for
lunch or to "hang out". In July of 2006, Rodney
invited Mindy and two of her girlfriends to his cabin.
He and his son Kirk were there, his wife was not.
During that weekend at the cabin, Rodney took pictures
of Mindy that focused on her body and breasts while
she was laying out in her bathing suit. Rodney is a
farmer and works at a Crystal Sugar plant. He was
fired from his manager job in Dec of 2005 for
manipulating the time clock for himself and other
employees. He would leave work without clocking out,
and return later like he was never gone. He lives and
works about an hour and 15 minutes from Valley City ,
where Mindy lives. Crystal Sugar eventually hired him
back spring of 2006.

Several of Mindy's friends gave statements that Rodney
called Mindy too much, they thought he was obsessed
with her and harassed her. One friend gave a statement
about when Mindy was yelling at Rodney to stop calling
her. After she was killed, almost every close friend
of Mindy's named Rodney as someone that they should
look at for her murder. They did not know details of
their relationship, but all said it was unnatural,
weird, and not right. When interviewed by
investigators, Rodney admitted to being inside of
Mindy's apartment only three times. He said he went
once with his son Kirk for Easter (2006), just to say
hi. He said they visited for about 30 minutes. The
other time was around June of 2006. Rodney says that
Kyle got engaged to a girl and that he needed to "tell
her the news in person". The third time, he told
investigators, he was looking to buy a large piece of
farm equipment (I forgot the name of it), and thought
he would find it one in a particular town. Mindy's
apartment was in the total opposite direction as this
town that he says he was going to buy the equipment.
When asked why he took this route for the equipment,
he said he thought he would just "ride around in case
he saw one for sale on the way". He says that he
passed through Valley City - and so stopped to see
Mindy and had lunch - and essentially made a loop to
the town he was looking for the equipment that added
about 1.5 hours to his trip.

He said he had hardly spent any time in her apartment,
and stated he couldn't even be sure he could find the
place. But when asked if they would find his
fingerprints in her apartment, he said at Easter he
made her a hand-made wooden plant-stand and there
could possibly be some there. The investigators asked
him if he knew if the stand was still in her place.
He proceeded to describe her apartment, walking in the
door, where the furniture was, what way everything
faced, and then even what pictures were on the kitchen
table.

Here is the most interesting thing- and why I bring up
Rodney Kuznia. He was asked if he was a racist. He
said no, he used to be, when he lived in Minneapolis .
But not any more. He was confronted with the fact
that he named all four of his children with the
initials KKK (Kyle, Kirk, Karissa, and Kelly). He says
it was a coincidence. Mindy was killed on a
Wednesday, the 13th. Rodney said the last time he saw
her was on Monday, the 11th. He admits to leaving
work without clocking out. He says he met with Mindy
and had lunch with her. He says that he gave her
$100, for her to spend on whatever. A note was also
enclosed with "Love, Rod" at the end. His own son,
Kyle, said he wouldn't have given one of his daughters
$20 if they asked. Rodney asked Mindy when they could
see eachother again, and Mindy told him Monday would
be the only day because she had to work all week.
This was a lie. On Tuesday, she happened to mention
to Kirk on the phone that she was planning on going to
a neighbor town to hang out on Wednesday, because she
worked Tuesday night, but then was off for the next
few days after that.

Rodney told the investigators he was working on his
farm all day and that Kirk saw him that day. And they
basically took his word for it. They took a sample of
his DNA, and that was it. Never verified his alibi,
never searched his car, home, phone records, didn't
look for any scratcheson his body, nothing. He very
strangely, called Mindy twice after he knew she was
dead and left messages to her on her answering machine
and cried. But since he was questioned Moe arrested,
he has disappeared off the face of the earth. He
loved her so much, so he says, "like his own
daughter", yet did not attend her funeral, dedication,
pre-trial or trial; he hasn't been seen since.

The investigation was performed in a botched manner
and still to this very day, is incomplete. There was
blatant and admitted ignorance about crime scene
processing. The North Dakota Crime Lab is overwhelmed
and inexperienced. The State's crime lab is intended
to be an independent and impartial institute. The head
of the DNA crime lab told the jury very bluntly when
asked by the defense on the witness stand,that she was
"an advocate for the State". Email conversations
between the lab and the prosecution team during DNA
processing (introduced as evidence in the first trial)
were clearly prejudicial. The prosecutor asked
straight out, with the DNA evidence found on the two
murder weapons that did not match Moe's, how could he
present his case to convince the jury that Moe was the
perpetrator! During the first trial, the lab manager
and the prosecution team "hung out", ate lunch
together, and were overly-friendly--- laughing
together without shame.

Here is a list of just a few mismanaged and basically
ignored items during this investigation.

1. Moe's DNA sample was taken, 24 hours later a match
came up on the HEDIS system, and he was arrested. A
press conference was given where the Sheriff stated,
"we are glad we got the monster off the streets" and
that the "case was solved". At this point, none of
the other items collected for forensics was tested
after the initial ND crime lab returned with the
match. This includes testing the knife handles, the
bottle of pine-sol, and the hair found in her hand.
(Moe is bald).

2. After his arrest, the investigation into leads
ended. This was admitted in Moe's taped interview and
during the pre-trial and trial. They made statements
such as, the investigation was over, we got our guy
already, and, "we didn't need to, Moe Gibbs killed
her".

3. The crime lab technician called the prosecutor and
told him to look for a guy with scratches. There was
no evidence of skin cells in any of the DNA samples.
This was an assumption that mislead the investigators.
She also admitted on the witness stand that she was an
advocate for the State and that they work closely with
the prosecution team.

4. Despite processing Moe's DNA in 24 hours, months
passed waiting on the ND crime lab to process any
other items. With the trial at hand, the defense had
to make a special request to the judge to force
testing of the remainder of the forensic items. The
defense and prosecution agreed on an independent lab
to complete testing in Texas . Oddly enough, once the
independent lab was involved, suddenly there is DNA
showing up that the ND lab never found.

5. DNA from a mixture of two males, neither being
Moe's was found in the fingernail scrapings of the
right hand. The same two males DNA was recovered from
BOTH knives and on the inside of a pair of rubber
gloves found at the crime scene. The only DNA samples
sent for comparison to the crime lab was Moe's and
Mindy's. No effort has been made to find out who
these two males are.

6. The hair in Mindy's left hand as well as the other
hairs found on her body were collected, but never sent
for DNA testing until the defense pressed the issue
and agreed to send items to an independent lab in
Texas .

7. The belt around Mindy's neck, which the killer had
to have had great tension on the ends of, was never
sent to the lab for testing.

8. Mindy had made a police report a week prior to her
death about a strange man who she felt was attempting
to attack her. He stopped to ask her for directions,
then got out of his car and proceeded to come up to
her very quickly with both hands extended out towards
her neck. She ran into her house and called the
police. This lead was admittedly never followed up
on.

9. This was a crime of passion, not a stranger crime.
The prosecution even admitted and began their opening
statement verifying Mindy and Moe had no ties to
eachother. She was not raped. She was not robbed.
"And we may never find out what the motive was".

10. Two men were seen running from Mindy's apartment
building in a suspicious manner by a delivery driver
around the time the prosecution believed she was
killed. They jumped into a brown car. This lead was
never followed up on, investigators admitted.

11. In July of 2006, only 2 months prior to Mindy's
death, ANOTHER young ethnic-looking female was found
hanging in her dorm room on the same campus.
Remember, Valley City 's population is 6400.
AMAZINGLY never brought up, this young lady was also
an X-girlfriend of Kyle Kuznia. She too, although she
was hispanic, white, and native american, had medium
brown skin and dark hair and appeared to be a mixed
black girl. Rodney slips and mentions her (Carey) in
his interview. This is when he said, Kyle's mom asked
why was he dating all these darkies. He went on to
explain, "Carey who was an Indian, and then Mindy, a
half-breed". Carolyn's death was admittedly
suspicious, but deemed suicide and never brought up
again.

12. ONE DAY prior to Carey's death, she filed a
police report about an older man she thought was
stalking her.

Just this past May, while Moe was sitting in jail
waiting for his first trial to begin, a third young
college girl (Anita Knutson) was murdered in her
apartment. She was killed with a knife, many details
were not released. This murder is unsolved, no
suspects. She was also adopted, a hispanic young
lady. All three of these ladies were ethnic, about 5"1
to 5"2, 105 pounds or so. Side by side pictures are
very difficult to tell apart. They all look very
similiar.

After Moe was arrested, two weeks after the murder was
committed, the investigators decided to luminol the
crime scene. They admitted on the witness stand of
the first trial that they had never used it before and
had to read the directions on the bottle to figure out
how.


After using luminol in the apartment hallways, down to
Moe's apartment, through his apartment as well as his
in-laws home, they were unable to find any trace of
blood tying him to Mindy's murder. The kitchen and
bathroom sink drains were removed form Moe's and his
in-laws place. No blood, no hair linking him. They
removed all the clothes and shoe items that belonged
to Moe in both places, still no blood, no hair. They
stripped his SUV vehicle, used luminol and searched,
still no blood, no hair. There have also been several
sets of fingerprints found that do not match Moe, and
do not belong to Mindy.

After finding out about the other DNA profiles found
on the knives and gloves and other her right hand
nails, no attempt to find out whose it belonged to was
made. Essentially, Moe has been in county jail for a
year and almost a month for 28 nanograms of DNA found
in the scrapings of her fingernails. 1 nanogram is
equal to one billionth of a gram. Other than that, the
prosecution has admitted in their opening statements
of the previous trial, they do not know of a motive.
Moe has an alibi that testified in the trial on his
behalf that he was on the phone texting and bringing
his wife a drink to her job at the time the murder was
committed. There has been no other link from Moe to
Mindy or Mindy to Moe found during this investigation.
There was other DNA found on her person, hair clutched
in her hand, other DNA profiles of unknown male under
her other fingernails, other male DNA profiles found
on the murder weapons, other people who should have
been more closely looked at as suspects who actually
had motives. And yet, MOE STILL SITS in jail as the
only accused.

We are desperate for some support. Moe is fighting
for his life in an all-white and openly prejudiced
area. We cannot even find a Black face to sit in the
courtroom on his behalf. Please, look into this. It
is a modern-day lynching and we do not have the power
to fight this on our own.

There is so much and so little time. There is so much
more to the story. I am willing to send any
documents/ etc to verify the statements I have made
above. We have no one to back us up here in North
Dakota . The defense lawyer asked us to "pack the
courtroom with black faces". That isn't even
possible. If you see some area we could get help,
please do not hesitate.

Girl I know he your brother but he is a murderer hunny. DNA was under his finger nails... he just so happen smell ammonia... he has a "sex addiction " mindy was cute. He has a long history he was leading up to this. Why did he rape those inmates .. why did your brother abuse his power of authority. Stop being delusional

It is very sad how you and your brother were raised, but he should have sought out counselling. He took his anger for his mother out on innocent and vulnerable young women. Then, you attempt to murder your own children in a suicide attempt??
Your family needs healing --generational healing. Both you and your brother ruined your own lives and your brother ruined the lives of many others.
I hope you are able to heal from your childhood trauma and come to terms with the heinous crimes committed by your brother.
I hope your children are doing well.
